These Terms of Service ("Terms") govern your use of our services and facility located at 34282 US Hwy 19 N, Palm Harbor, FL 34684. By booking an appointment, using our services, or visiting our facility, you agree to be bound by these Terms.

1. Services Overview

CRYOGENIX offers various wellness and recovery services including, but not limited to:

• Whole Body Cryotherapy
• Infrared Sauna Therapy
• Red Light Therapy
• Laser Body Contouring
• CryoSlimming
• Body Sculpting
• Lymphatic Massage
• Aspen Laser Therapy
• InvisaRed
• Other wellness services as offered

Services and availability are subject to change without notice.

2. Eligibility and Medical Clearance

Age Requirements

You must be at least 18 years of age to use our services. Minors may only receive services with written parental or guardian consent and supervision as required by law.

Health Conditions

You agree to:

• Accurately complete all intake forms and health questionnaires
• Disclose all relevant medical conditions, medications, and health concerns
• Obtain medical clearance from your physician when recommended
• Inform us of any changes to your health status
• Follow all contraindications and safety guidelines for each service

Certain services may not be suitable for individuals with specific medical conditions. We reserve the right to refuse service if we believe it may pose a health risk.

3. Appointments and Cancellations

Booking

Appointments can be scheduled through our online booking system, by phone, or in person. All appointments are subject to availability.

Cancellation Policy

• Cancellations must be made at least 24 hours in advance
• Late cancellations (less than 24 hours) may result in a cancellation fee
• No-shows may be charged the full appointment fee
• Repeated late cancellations or no-shows may result in restrictions on future bookings

Late Arrivals

Please arrive on time for your appointment. Late arrivals may result in shortened sessions or rescheduling, and you may be charged the full appointment fee.

4. Payment Terms

• Payment is due at the time of service unless other arrangements have been made
• We accept major credit cards, debit cards, and cash
• Prices are subject to change without notice
• Package and membership terms are non-refundable unless otherwise stated
• Outstanding balances must be paid before booking additional appointments
• A processing fee may apply to returned or declined payments

5. Refund Policy

All sales are final. Refunds are generally not provided except:

• In cases where we are unable to provide the service you paid for
• When required by law
• At our sole discretion in exceptional circumstances

Package deals, memberships, and promotional offers are non-refundable and non-transferable.

6. Assumption of Risk and Liability Waiver

By using our services, you acknowledge that:

• You assume all risks associated with participation
• You release CRYOGENIX, its owners, employees, and affiliates from liability for any injuries, damages, or losses arising from your use of our services

Our services are intended for wellness, recovery, and aesthetic purposes. They are not intended to diagnose, treat, cure, or prevent any disease. You should:

• Continue to follow your healthcare provider's recommendations

• Understand that individual results may vary

8. Conduct and Facility Rules

While using our facility, you agree to:

• Treat staff, other clients, and property with respect
• Follow all posted rules and staff instructions
• Use equipment properly and as directed
• Maintain appropriate hygiene and attire
• Not be under the influence of alcohol or recreational drugs
• Refrain from disruptive, threatening, or inappropriate behavior

We reserve the right to terminate services and remove any client who violates these rules without refund.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of CRYOGENIX or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

10. Photography and Marketing

We may take photographs or videos at our facility for marketing and promotional purposes. By using our services, you consent to being photographed and grant us permission to use such images. If you do not wish to be photographed, please inform us in writing.

11. Limitation of Liability

To the fullest extent permitted by law, CRYOGENIX shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or facility. Our total liability shall not exceed the amount you paid for the specific service in question.

12. Indemnification

You agree to indemnify and hold harmless CRYOGENIX, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, violation of these Terms, or violation of any rights of another party.

13. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in Pinellas County, Florida, except that either party may seek injunctive relief in court. You waive your right to participate in class action lawsuits.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
